FOR IMMEDIATE RELEASE Date: 01-19-12 The City of South Daytona from Jeanne Willard, Public Information Officer FPL Supported Petition Deemed Not In Compliance With Laws SOUTH DAYTONA – A petition circulated by the FPL-backed political committee “Take Back Our Power” (TBOP) is not substantially in compliance with the Division of Elections standard petition form, and the City has been advised by legal counsel to return the signed, unapproved forms to the Political Action Committee. (See attached.) In an effort to conduct its city elections in accordance with state law, the City retained legal counsel which determined that the format “departs from the state-adopted form in a material way” by not including statements informing voters that all information on the form, including signatures, becomes public record, that it is a crime to knowingly sign more than one petition and that the form will not be valid if all requested information is not completed. In addition, counsel contacted the Division of Elections, who advised that the Division would not approve any petition form that did not include this information. City Attorney Scott Simpson concurred with the opinion and recommendation. The FPL-funded petition drive effort follows a protracted legal battle between the City and the utility over the City’s right to exercise the purchase option contained in its franchise agreement to buy the electrical distribution system, despite the fact that the City already voted to purchase the utility in July. Following the Federal Energy Regulatory Commission’s ruling that FPL was not entitled to stranded cost, the City received a letter from FPL stating that it was forming a PAC to amend the City Charter in an attempt to stop the City from buying the system. Financial documents filed by the PAC show that FPL has contributed $20,000, while residents have contributed less than $300 to date. TBOP was previously given notice regarding the petition format. On Dec. 9, TBOP submitted the charter amendment petition to the City. The City Clerk denied TBOP’s petition format, directing TBOP to resubmit the petition in accordance with the State’s pre-approved petition form. TBOP responded that it believed that it was in compliance and proceeded to collect signatures on the unapproved petition form. Those signed petitions were submitted to the City in January. ###

...I have been treated for chronic pain due to degenerative disc disease and multiple surgeries since October 2010. Since the new laws intended to close the illegal pain clinics went into effect, I have not been able to get an internist or general practitioners to write scripts for medications I've been taking. They are not willing to register with the state and have a bureaucrat tracking the prescriptions they write. I have never abused the drugs written for me and yet I am suffering because I have run out of pain patches and pills. I have contacted three pain management doctors on my new plan, and the earliest appointment I could get was the end of this month. In the meantime, I have to deal with my situation on my own....

LEAVING KEYS IN CAR IS OPEN INVITATION TO THIEVES
Don’t make life easy for car thieves by leaving your car keys in the ignition. It might seem harmless to leave a car running in a store’s parking lot while you dash inside “just for a minute.” But that minute is all opportunistic thieves need to take off with your vehicle. Making the scenario potentially worse is when children are left unattended in a vehicle. Not only is this dangerous, it’s also a crime.
A 60-year-old man suffered the consequences of leaving his keys in his car when he went into a convenience store near Daytona Beach Jan. 15. He watched as a man jumped into the unlocked vehicle, used the keys left in the ignition to start it up, and then speed away. His car was later recovered, but the theft could have been easily prevented by simply taking his keys with him. There are other similar incidents where vehicles were stolen because spare keys left inside were easily found or the owner was distracted and forgot to take the keys with him or her.
Deputies want to prevent crime, not write a bunch of tickets. However, leaving keys in the ignition of an unattended vehicle is a nonmoving traffic violation subject to a $116 fine. Even more significantly, it’s a crime to leave a child younger than six years old unattended in a vehicle. The person responsible for doing so could face a second-degree misdemeanor if the child is left for more than 15 minutes. If the vehicle is running or the child is in danger, the responsible person could also face a noncriminal traffic fine of up to $500. Deputies will be vigilant for all of these infractions, especially in convenience store and grocery store parking lots where motorists most often leave keys in their cars or leave the engine running.
