922 on 2 7 12 The Port Orange City Council finished tonight's council meeting some 15 minutes ago. hopefully my dvr recorded the session and hopefully I can find some time tomorrow to show you some video segments of the council meeting. It was interesting to hear Don Burnette's evaluation of the city manager, done by reviewing the 9 pages of last year's goals offered by the city manager, and Don scored the CM a mark of 86.9 percent. Bob Ford followed with a comment that the city council should give the city manager goals for the year, and then grade him on his work performance. Bob Pohlman had a lot of praise for Ken Parker, and I guess Bob is suffering with a bad cold which was evident. Hope he takes lots of fluid and has medication at home, because in Port Orange a doctor can not dispense or prescribe medication after 9 pm. Even good, retubable doctors are forbidden by the ordinance. The city council had thought such an ordinance was necessary. Reminds me of the blue laws in New York State in the 60's when it was illegal to sell aspirins on Sunday to parents who wanted to take care of a sick child. -- hank poanposted 9 31 pm. 2 7 12

On the Port Orange City Council Agenda, February 7th
Item 25 - Authorization for Wayne L. Helsby, Esquire to Initiate Litigation Proceedings for Enforcement of the Public Employee’s Relations Commission Decision PERC’s Order finding that the International Association of Fire Fighters, Local 3118 (“IAFF”) committed an unfair labor practice by not conducting a ratification vote has not been appealed. Staff recommends initiating litigation to require the IAFF to conduct the ratification vote. Staff recommends authorization for Wayne L. Helsby, Esquire to file a lawsuit in the Seventh Judicial Circuit, Volusia County, Florida, for enforcement of the Public Employees Relations Commission (“PERC”) decision rendered on December 22, 2011, in ULP Case No. CB-2011-061, and authorize its continued prosecution on behalf of the City.
City Manager Comment: The City continues to work with the IAFF on contract negotiations. We will be conducting another workshop with the Union and the Actuary attempting to reach an agreement with the Union on contract issues. However, PERC has ordered the Union to conduct an election on the Impasse contract. More than 30 days has lapsed since the PERC order. In the statute, Circuit Court is the venue for enforcement of the PERC order. Although we will continue to meet with the Union on attempting to reach agreement, we are requesting permission to go into Circuit Court to seek a court order if necessary to compel the Union to conduct a ratification vote. They have raised two issues. Our labor counsel has addressed those issues with their attorney. Both of the issues should not be addressed pre-vote since those questions would have to be addressed in a post vote discussion. |

Employers must have health insurance for workers covering contraceptives and abortion.Last night on internet am radio, I was listening to a talk show from Philadelphia, WPHT. There were a series of interesting opinions on the Obama Health Insurance issue. Besides the issue of Catholic social organizations being forced to carry health insurance for their employees which cover contraceptives and birth control, the larger issue is that the insurance companies are drinking champagne, toasting the millions of increased dollars that will come to them, by Obama mandating the additional health coverage. It is speculated that more employers will simply drop health insurance benefits for their employees, tending to bring the nation to a one payer, federal health insurance, something that Obama has been striving for. The speculation seems to be reasonable to me. For the record, because of the expensive manipulation of the health care system by the insurance companies, I would like to see the commercial insurance companies corporate greed, eliminated from the equation. And, I send this section to my brother, a cardiologist, reminding him of our conversation over 25 years ago, in our parents' home in Little Neck, NY, where I predicted to him that this nation was headed towards socialistic type of health system because of the yearly increases in health costs. Do you remember that part? - do you remember that - that was cool! -- I suggest teaching your children that the real world is not like the fairy tales, and that there are a lot of dumb people out there who hate the other political party, not seeing that their own political party is demonic too. There also are a lot of dumb people out there who think the wisdom of a fairy tale will solve real world problems. But I am so glad you care. During the second world war, my dad worked long hours at the sperry's defense plant. 7 days a week. I remember him always trying to stay awake when he was home, but snoringly falling asleep in his chair. After the war was over, he returned to normal working hours, and enjoying fishing, he often took me on a charter boat going out of Sheephead's bay on weekends. We went on Capt. Izzy's boat. During the week, he kept up with fishing reports in a 7 am news radio fishing report. The introduction to the fishing report section played the song, Sailor's Hornpipe. Whenever I hear the song, I have happy memories of fishing with dad on weekends. -- hank
